Fraud/Low Impact

The department was established in 2002 following a sharp increase in instructions as a result of consistently achieving high standards and impressive results for existing clients in relation to fraudulent claims. It is run by Partner Mark Hudson and consists of 12 solicitors and 11 litigation executives. Further expansion is continuing.

All types of motor fraud, including staged/contrived accidents, bogus passenger claims, ghost vehicles and fraudulent vehicle damage claims are dealt with. The department has its own database, has access to the Motor Insurance Database Information System and CUE PI and is a member of the Insurance Fraud Investigators Group. In addition, many claims for excessive credit hire are dealt with.

In the field of low impact cases, the department has attained a reputation as a market leader and a feared opponent. Extensive research has ensured that all staff are fully conversant with the science and biomechanics of low velocity collisions, and its level of expertise and experience has enabled it to be tactically astute. This in turn has led to a substantial number of successes, including many such cases being dismissed at trial, and recovery of costs in low impact cases from claimants of more than £2.5 million.

In addition, the department was responsible for taking to the Court of Appeal the two leading cases of Kearsley v Klarfeld and Casey v Cartwright, which together changed the face of low impact legislation.
